Introduction
Welcome to IP Moat Ltd. Our services are designed to assist in the detection and removal of counterfeit listings from online marketplaces, protecting intellectual property rights. By using our services, you agree to be bound by these Terms of Service (ToS).
Limitations of Liability
IP Moat Ltd. will not be liable for any direct, indirect, special, incidental, or consequential damages, including loss of data or profit, due to the use or inability to use our services, materials on this site or our apps, or the actions taken based on the information provided. This limitation applies even if IP Moat Ltd. or an authorised representative has been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you.
User Declarations and Responsibilities
By using IP Moat Ltd.'s services, you declare in good faith that:
- You believe the material in listings flagged for removal is not authorised by the intellectual property owner, its agent, or the law.
- All information you provide is accurate, up to date, and you agree to update such information as necessary.
- You are authorized to act on behalf of the intellectual property owner of an exclusive right that is allegedly infringed.
You acknowledge that while IP Moat Ltd. facilitates the removal of online listings, the ultimate responsibility for the decision to remove listings and any resulting liability rests with you, the user.
Authorization to IP Moat Ltd.
As the intellectual property owner, or an authorized agent, you grant IP Moat Ltd. the authority to act on your behalf in processing the removal of identified listings.
Fair Usage Policy
Our goal is to provide all IP Moat users with the best possible service. To ensure the platform performs optimally for everyone, we have a Fair Usage Policy that applies to the use of our services.
1. Definition of Fair Usage
IP Moat allows users to add and manage products without a fixed limit. However, to maintain the quality and performance of the platform, we monitor for usage that exceeds what we deem reasonable for typical customers. This includes, but is not limited to:
- Excessive use of system resources
- Automated or scripted processes adding or modifying products and other data at an unsustainable rate
- Behaviour that negatively impacts the experience of other users or the functionality of the platform
2. Monitoring
IP Moat reserves the right to monitor account activity to ensure compliance with this policy. In cases where we detect behaviour that we consider excessive or unusual, we may take action to maintain platform integrity.
3. Action Taken in the Event of Excessive Usage
If your account's usage exceeds what is considered fair or reasonable, we may:
- Contact you to discuss the situation and suggest adjustments
- Temporarily or permanently limit your account’s functionality
- Apply additional fees to cover the excessive use of resources, if applicable
Feature Limitations and Data Coverage
While IP Moat Ltd. strives to provide accurate and comprehensive data, we do not guarantee 100% coverage of all listing information. Certain data fields—such as seller names, pricing, or screenshots—may occasionally be unavailable or incomplete due to limitations from third-party marketplaces or technical constraints.
For Enterprise plans, we endeavour to capture screenshots of removed listings; however, we do not guarantee screenshot availability for every removed listing.
If you downgrade from the Enterprise plan or cancel your subscription, previously captured screenshots will be retained for 30 days following the change. After this period, screenshots may be permanently deleted and will no longer be recoverable.
Account Cancellation and Post-Cancellation Actions
When an account is cancelled, access to the IP Moat platform will remain available in read-only mode. Users may continue to view previously collected data, including past listings and reports. However, no new listings will be monitored, and no additional takedown requests will be submitted.
Any takedown requests submitted before cancellation may still be processed, but IP Moat Ltd. is not obligated to pursue resubmissions for rejected listings after the cancellation date. An active subscription is required for ongoing monitoring, takedown submissions, or resubmissions.
Referral Program
1. Eligibility
The IP Moat Referral Program is open to all current subscribers of IP Moat Ltd. Participants must be in good standing with their subscriptions to be eligible to participate in the Referral Program.
2. How to Participate
To participate, share your unique referral link with other brands. The referred brand must use your unique link to sign up for an account for the referral to be valid.
3. Referral Rewards
- For the Referred: From time to time IP Moat may offer incentives to the referred party such as a number of free removals. To receive any referral benefits the referred party must sign up through a valid referral link.

For the Referrer: If the referred brand upgrades to a paid account, the referrer may receive a benefit. This may vary from time to time and may include;
- one month of free subscription to IP Moat Ltd, up to the monthly value of the referred brands plan. Such rewards will be applied to the referrer's subscription at the end of their current billing cycle.
- a cash incentive. Such rewards will be applied to the referrer's subscription at the end of their current billing cycle or be paid using a method of IP Moats choosing.
4. Limitations
- Rewards are only applicable when the referred brand signs up for a new IP Moat Ltd account through a valid referral link and subsequently moves to a paid account.
- Referrers cannot refer themselves or create multiple accounts to gain additional referral benefits.
- Free subscription months earned through the Referral Program are non-transferable and cannot be exchanged for cash or any other forms of credit.
- Transfer of any monetary benefits will be paid in Great British Pounds Sterling. Any costs due to exchange rates, bank fees, processing fees and transaction fees will be deducted from the benefit.
5. General Conditions
IP Moat Ltd reserves the right to modify or terminate the Referral Program at any time and without prior notice. Additionally, IP Moat Ltd reserves the right to disqualify any participant at any time from participation in the program if they do not comply with any of these Terms and Conditions.
All participants agree to abide by these Terms and Conditions as part of their involvement in the Referral Program. Disputes related to the Referral Program will be resolved at the sole discretion of IP Moat Ltd.
Data Privacy
IP Moat Ltd. is committed to protecting your privacy. Please refer to our Privacy Policy for information on how we collect, use, and protect your data.
Modification of Terms
IP Moat Ltd. reserves the right to modify these terms at any time. We will provide notice of significant changes and, by continuing to use the service, you agree to be bound by the revised terms.
Dispute Resolution
Any disputes or claims arising out of or in connection with the use of IP Moat Ltd.'s services, including any questions regarding its existence, validity, interpretation, breach, or termination of these terms, shall be governed by and construed in accordance with the law of England and Wales. The parties agree to submit to the exclusive jurisdiction of the courts of England and Wales for the resolution of any disputes.
By using our services, you consent to the jurisdiction of the courts of England and Wales and waive any objections to the jurisdiction or venue of such courts. This agreement to submit to the jurisdiction of the courts of England and Wales includes any claim or dispute that might arise between you and IP Moat Ltd., related to your use of our services or these Terms of Service.
